Turning a Lottery Loss Into a Green Card

Person with briefcase walks on winding path. Signs read H-1B Lottery, O-1 Visa, EB-1A Green Card. Text: Immigration Isn't Linear.

Two years ago, a client with a STEM degree didn’t get picked in the H-1B lottery. Here’s how we turned it around to a long-term solution:

We pivoted. Started building an O-1 visa case instead.

In July, she was selected in the second lottery. So we pivoted again. Filed the H-1B. Got approved.

About a year later, the employer decided to pursue a Green Card for this valuable employee.

We’re now working on her EB-1A — the green card for individuals with extraordinary ability.

Here’s the thing: all that O-1 research we did? We never filed it. But we’re using it now to support the EB-1A application.

The work wasn’t wasted. It just found a different home.

Immigration rarely goes in a straight line.

Lotteries don’t go your way.

Timelines shift.

Plans change.

But the preparation you do for one path often supports another.

So, document your wins.

Keep your evidence organized.

Continue working on improving your career.

You may need it later for something you haven’t planned yet.

If you’re navigating the H-1B lottery (entries start in March) or thinking about O-1 or Green Card options, call (949) 940-6725, or book a consultation online to speak with one of our experienced immigration attorneys.
